Legal Question in Personal Injury in Wisconsin
I went to a gas station last night to get coffee and when i picked it up a little splashed out at me. Instantly going threw my glove and hand. When i got in my car i noticed that it had literally burned layers of skin off and is the size of a fifty cent piece. Its a completely open raw wound. I work in a restaurant and deal with coffee all the time and have spilt it on my bare hand but never anything like this. I have taken pictures but does it pay to purse this or should i just know better next time then to get coffee from this place.

Did you contact the gas station after the incident occurred to report it to them? Did you receive any medical treatment for the injuries? If you did not report it at the time, you will obvoiusly have issues in proving how, where and when it happened. If you did not get medical treatment, you will also have a more difficult time proving your damages. That being said, you can certainly make the claim to the station and try to convince the insurance company to pay you for the damages and injuries you sustained. Please be aware that in Wisconsin, there is a three year statue of limitations, which means that you must either settle your claims or commence a lawsuit within three years from the date of the incident. You can certainly also contact the Health Department and report this to them to see if they would check out the station and the coffee pot to determine if the temperature of the coffee is above the recommended temperature.
