Legal Question in Personal Injury in Wisconsin

Injured By Minors

I was injured by two 16 year olds whom I have never met until the moment bodily injury occured to me (an adult). They claim it was an accident. I'm not so sure. None the less I have emergency medical bills, orthopedic and physical therapy and just a matter of time I will most likely need surgery. The injury has caused permanent damage. I have been out of work 6 weeks and am a self employed constrution worker. So I have lost income as well. not to mention the constant pain I'm in.

What kind of recourse do I have if any?

In most states you have the same rights to sue minors

as to sue adults, as long as you jump through a few

hoops such as having a guardian ad litem appointed

for them. Additionally, you may have the

right to sue their parents under various parental

responsibility statutes. The big question is

whether it is worth bothering. Any reason to believe

they or their parents have non-exempt assets? Is

there any insurance available?
