Legal Question in Personal Injury in Wisconsin

lead poisoning cases

I would like to know if there is any legal action that can be taken in a lead poisoning case. My daughter contracted lead poisoning at the age of 2 from a rental property. My problem is that the landlord has no insurance on these properties and so I can't go through her. I was wondering if there is anyway to go after the paint makers and if there is an attorny in my area that could take the case.

Although I have not handled such cases, there was a landmark decision that was decided by the Wisconsin Supreme Court in 2005, Thomas v. Mallett, in which the Wisconsin Supreme Court allowed a person injured by lead paint to sue a number of manufacturers of lead paint on a risk-contribution theory. The plaintiff in that case was represented by Attorney Peter Earle of Milwaukee. I would recommend that you contact Mr. Earle to determine whether your daughter might have a case that ought to be pursued.
