Legal Question in Personal Injury in Wisconsin
I am a roofer, and the company I work for was contracted by the CENEX corporation to re-roof the roofs on their buildings. Located on the backside of the building are several plastic chemical/liquid storage containers. During the tear off faze some debry fell on top of the storage containers. Later on during the clean up faze i was attempting to clean off the top of the storage containers when the 2500 gallon plastic container's roof caved in sending me face first into 1500 gallons of liquid feed molasis. a couple of co-workers were finally able to pull me out of the huge plastic barrell/container. I hosed off then went home to throughly clean up. Over the next few weeks my stomache was cramping and hurting and then one day it was hurting severly and I ran to the bathroom and defecated only blood and intestinal tissue. I went to the hospitol and after X-rays,catscans, blood work etc.. I was diagnosed with colitis/ulcerative colitis and am now undergoing medical treatment. Would I have a claim against the Cenex corporation for their chemical/storage containers being unsafe and endangering my life because of being in unsafe upkeep and outdated?

When you suffer an injury, as you did, it would certainly be a good idea to determine how and why you got the injury and whether some other party is responsible. The first question that will need to be answered is this: does your physicial indicate that your illness/injury is a result of your fall into the tank? If this answer is "yes", then more questions need to be answered, which will all relate to how you performed the work and whether the company had a duty to have a tank that could have held your weght (or at least have it marked that it couldn't) or whether you performed in such a fashion that your own actions caused your injury. While a law firm you may work with may be willing to assist you in putting together a team of experts who can testify, so will the other side, so this question may ultimately be answered by a jury. In short, you need to meet with and talk with an experienced injury attorney who would be willing to handle this unusual case. Best regards for a quick recovery.
