Legal Question in Personal Injury in Wisconsin

About three years ago, my sister was knocked down by a boy at her school and her knee was hurt very badly. She had to have surgery and was in a lot of pain. However, my mother signed off with the other family's insurance, so she is unable to sue them for the operation. Since then, my sister's knee injury has acted up countless times and she is still in a lot of pain. About a year ago, she had another surgery. Now, her knee is acting up again and she is going to the doctor--possibly to find out she will need another operation. Is there any way to get compensation for this, seeing as my mother signed off? Thank you

In my opinion, about the only way that your sister may seek further compensation would be if your sister was a minor and the settlement was not approved by a judge, as required by Wis. Stat. sec. 807.10. The other requirement would be that the statute of limitations has not expired. There have been cases in which an injured person was able to pursue a claim, despite a release having been signed, but those are the exception and not the rule. You will have to consult with a lawyer to discuss the facts of your sister's potential claim.
