Legal Question in Personal Injury in Wisconsin
How do you sue insurance company when involved in an accident that other person lied about, yet accident report states other person got citation and officer believes your version based on his experience and damages suffered by both vehicles?
1 Answer from Attorneys
I suggest that you consult with an experienced personal injury attorney to discuss the facts of the accident and review the accident report. Sometimes, if there is a dispute as to how the accident happened and who was the majority at fault, the insurnace company for one of the parties will take the position that their insured was not at fault or less at fault, and deny the claim for injuries and damages. This happens somewhat often. An experienced attorney may review the facts, investigate the accident, obtain statements from witnesses, hire investigators, consult with an accident reconstruction expert, and do other things to help provie to the other insurance company that their insured driver is the majority at fault. Therefore, I think your best course would be to consult with an experienced attorney concerning the facts of yoru accident. Sometimes the police officer can be used as an "expert" in the case, depending upon what he did in investigating the accident. Please be aware that in Wisconsin, an adult generally has three years from the date of the accident to either settle a claim or start a lawsuit for injuries and damages. There may be some shorter time requirements depending upon the identity of the other driver.
