Legal Question in Real Estate Law in Wisconsin

Must I Build the Fence???

One property owner wants to get horses. The owner of the adjoining property has no pets or

animals. The person who wants to get the horses wants the other owner to pay for half of the fencing cost of the mutual property line. Must I pay? The properties are in rural Wisconsin,

land that formerly was farmed, but is now considered residential.

Thank you very much.

Re: Must I Build the Fence???

I believe there exists an old state statute on the

books that requires landowners in rural areas to built

one-half of each fence adjoining a neighbor, I think

the right half as you're facing the exterior border

from the inside of the property. This would probably

require a look at the current statutes and cases to

see if more developed areas are no longer subject to

such law.
