Your best protection would occur if you consulted an attorney before you signed an Offer to buy the property you are considering. The attorney would then review the Offer, the related property condition report, advise you as to contingencies and review any documentation obtained to verify that contingencies have been met, advise you as to how to hold title, review the closing documents, which at a minimum would include: title committment, closing statement, most recent real estate tax bill, bill for title services, affidavit regarding possession and liens, special assessment letter, mortgage payoff letter, and a host of items that could come up as a result of whatever else may be on the title report.
