Earnest money refund

We accepted an offer to purchase on the sale of our home in January 2004. We accepted this offer with a contigency that the buyer must sell their home and we must close on or before April 2004. The end of April is upon us and the buyer has not sold their home.

Are we legally responsible to refund their earnest money? Or is that considered a breach of contract and that money is now ours??
