Eviction
If an 5 day notice to quit or pay rent is delivered to the tenant, and the land lord is notified in the middle of the month that the rent will be paid before the end of the month. But on that same day the land lord files a motion in small claims court for eviction on unpaid rent before the month is up and verbally agrees that they will accept the rent as long as the next months rent is on time, is the landlord still able to evict the tenant if the rent is paid before the end of the month, and do they have to accept it as long as the month has not ended yet?

If the landlord's agreement was made part of the
court record, or if the landlord entered into such
agreement with the tenant such that the tenant can
adequately document the existence of the agreement,
the landlord would be obligated to honor his
agreement.
