Legal Question in Real Estate Law in Wisconsin

Forclosure after divorce property settlement

As part of the divorce agreement my husband was given 60 days to refinance or put the home for sale. 60 days passed the house put on the market but he apparently stopped paying the mortgage and now legal action has been started to forclose. I am not in a postion to take over the mortage and want to know what my options are. Should I file bankruptcy?

Re: Forclosure after divorce property settlement

Hello,

Unfortunately it is not possible to answer this question without more facts. In part, it depends on how your divorce decree reads in total, which I dont know. Also, whether a bankruptcy is in order depends on reviewing your income, debts and assets. Finally, I dont know whether there is any equity in the home; I guess not. I have an office in Green Bay on Potts Ave. If you want to ask a couple questions of my paralegal Robyn Davis, feel free to call her, or to call if you want want a free consultation to examine your alternatives. Best wishes,
