home forclosure

i have filed chapter 7 and a forclosure on my home was the end result. my bank forclosed and sold the house for thirty thousand more than what i owe. am i intitled to that money? where did the excess go? i cannot get any intformation from my bank, can you give me some insight?

Hello Linda,

It is very difficult to advise you because I have only the facts you have here, which is not enough to go. You should be able to find out from the bank where the money went, you just have to be persistent. Maybe it went to the bankruptcy trustee to pay creditors, but if so, the trustee has to let you know that too. I don't know whether you could have saved that money if you had done things differently with the foreclosure and bankruptcy, because again I don't have enough facts. My suggestion is to pester the bank and bankruptcy trustee to get an answer, and then to consult with a lawyer if you can to see if you have any options.
