Legal Question in Real Estate Law in Wisconsin

Hi. My house is in foreclosure, and I have to answer the notice with the next six days. I have been working with a realtor and the house has been on the market for about 4 months. We have an offer, although it will technically be a short sale. If I give him permission to pursue the short sale, how should I answer the foreclosure summons? Do I answer? Do I ask for mediation? Thanks!

Everyone who is in foreclosure should be represented by an attorney, since they are extremely complex lawsuits that go on for years, with consequences which can follow you for decates, but that is especially true if you want the foreclosure to pause long enough to permit a short sale. Your lawyer will answer the foreclosure summons for you, since there are complex potential legal defense which must be properly noted there or lost. Mediation can also be a good tool, but any small leverage that you have to negotiate will be lost unless your lawyer first preserves your rights. Short sales are at least as fraught with perils as the foreclosure, so representation there is equally important, and you can use the same lawyer for both if he or she has that sort of experience.
