Your rights and duties in this situation are controlled by the terms of your contract. Without seeing it, I could therefore not advise you. There are also some minimum requirements under WI law for residential home improvement contracts, including a requirement for a written completion date, among others. You therefore need to have an experienced civil litigation attorney investigate your situation as soon as possible to advise you. Withholding payment is sometimes the homeowners most effective remedy, although you should probably consider having a different person finish the job rather than inviting someone back in with whom you are dissatisfied (and who may be equally dissatisfied with you). Withholding may also trigger a suit against you by the contractor, so you should be prepared to deal with this possibility by having a lawyer evaluate the merits of your case. You will probably need a neutral contractor or structural engineer as an expert witness. My comments here are not intended as legal advice and do not create an attorney client relationship between us.
