Legal Question in Real Estate Law in Wisconsin
I have a judgement, and would like to levy bank account, what do I need to do
1 Answer from Attorneys
Non-earnings garnishments are tricky procedures, even for attorneys. Rather than wasting your money on court filing fees for garnishments which will end up getting dismissed with no net proceeds for you, you should consult with an attorney with experience in bankruptcy matters, since that is likely to be the result once you file such a garnishment, and steps can be taken to plan for it. Debtors can often get the money returned to them if they can file within a period of months after you get the funds. The WI exemption for bank accounts is frequently as much as $5K per debtor if your recovery is less than that, which would entitle them to later return of the funds of up to $5K even if you succeed, assuming the debtor raised the issue.
