Landlord disrespectful of tenants property
Our landlord has decided to do the lawn mowing and has increased our rent $100 per month for this. When he is mowing the grass he takes our lawn furniture, plants, etc. and throws them out of his way. He also parks in the driveway blocking our parking spaces. Does he have the right to do this to us? What action should we take if he does not have the right?

I sounds as though he is not very happy to be there.
Were you originally supposed to do the lawn and he
took over because you didn't do it often enough? Your rights
in this regard will be determined by your lease, so
I'd need a lot more information in order to answer
question. An easy alternative would be to read over
the lease yourself, but I'd be happy to follow up and take a look
if you can e-mail me a scan of it. If you don't have a written lease,
your rights will be determined by statute combined with the
history of your dealings. Landlords generally have
rights of entry with notice for reasonable maintenance,
and probably don't even need to give notice for outside
maintenance. You, on the other hand, have the right
of "quiet enjoyment" of your tenancy. Sufficiently
sever interferance with that right can amount to
constructive eviction and allow you to get out of
the lease and find a quieter place.
