Legal Question in Real Estate Law in Wisconsin
Do I need a lawyer?
If two people who are not married purchase a property
(house) together, and they write up an agreement
between them of what should be done in case the
relationship dissolves either by choice or death; will
that agreement hold up in a court of law? If not, what is
the most economical procedure to pursue to have our
wishes followed. I contacted a lawyer and it is very
costly to have him draft the needed documents.

Re: Do I need a lawyer?
Hello,
It is difficult to answer your question because I do not have all the facts. If, as you say, something just needs to be done to do what your wishes are in the document, that should not cost a lot. Likely someone has to be paid something, or the property be sold, etc. However, if the two people don't agree or won't coooperate, and one party needs to try to enforce the document, that's where it becomes more expensive. That person may have to bring a legal action to get the document enforced. Is it enforceable? That depends on how clear it is, and its compliance with the law. Things I don't know. Talk to a couple of lawyers about costs and alternatives and maybe you can find one you can work with or work with you. Good luck, Mark J. Mahoney 920-984-4529
