Legal Question in Real Estate Law in Wisconsin

Offer to purchase discrimination

My sister put an offer in on a FSBO home and offered the owner their asking price with no contingency. She is also pre-approved for her loan. She gave the owners until today to accept and now they say they are not sure they want to sell it to her. They want to see if any other offers come in. Can they do this??? They have not taken the house off the market just don't want to sell it to her. Please help.

Re: Offer to purchase discrimination

If the Seller did not "accept" the offer then the Seller is not bound to continue on with the transaction. Whether a Seller accepts any given offer is a decision left solely to the discretion of the Seller. That discretion is only limited by laws that prohibit discrimination based on an illegal reason. I am not sure from your question whether that is something you feel happened in this transaction.

If the Seller did "accept" the offer, then the Seller may be bound to complete the transaction. Acceptance is defined in the Offer to Purchase at lines 17 - 19 of the WB-11 Residential Offer to Purchase.
