Legal Question in Real Estate Law in Wisconsin
Can an opposing Attorney force you to give a deposition
We went to court to try and get back the remainder of our security deposit. The exlandlords attorney wants us to give a deposition in his office. We want to know if we have to do this. And if he supeona's us do we have to say anything once we are there? We started this suet and we beleive they are just trying anything to stay out of court. We have been trying for months to get this in court and over and now there attorney wants a deposition from us. Why?
What are the legal ramifications if we don't?

Re: Can an opposing Attorney force you to give a deposition
The answer is "yes" you can be forced to give a deposition.
If you fail to cooperate, your case can be dismissed
and you could end up paying your landlord's legal fees
and court costs. There are motions you can bring to
avoid it, but you must win those first, otherwise
things will go badly for you. You are engaged in
what is known as formal discovery at this point in
your lawsuit,a very routine proceedure. However, it
is more complex than most lay persons can handle.
My advise would be to seek legal counsel immediately.
