Legal Question in Real Estate Law in Wisconsin
I have own my property for 10 years now. I had a certified survey done to build a garage. My neighbor now wants 15 feet of my property because he thought that is where the property line was. I let him plow snow onto it in the winter so now he wants it incase I change my mind. Those are his words. It has been check by another surveyor and it matches mine.He has told me he deserves it because of the lay of the land and he thought he owned it anyway so I will be contacted be his lawyer. Does he have any right to it? My Deed matches the surveys. Thanks Randy

Upon what legal theory is he planning to sue you? Errors in your survey? Adverse possession? If I were representing you, I would request clarification from him before planning any next step. A court would never order land to be conveyed just because a neighbor wanted the land; the neighbor would instead need to prove that he had some legal right to it under one of the above theories, or on such grounds as an enforceable contract to sell, inheritance/probate court order, the existence of a valid deed conveying it to him, etc. The list of potential legal theories is endless, but it does not sound like he has presented any of them to you yet.
