I co-own a home with another person who has not made a mortgage payment nor lived at the residence in 3 years. Does this person still have legal rights to this property?

yes. If there name is on the title, they are presumed to be an equitable owner. If you have no written agreements, a partition action would be required to establish each person's rights to the asset based on their contribution to the asset.
