Normally, any tax can be paid in full over up to five years in a chapter 13 bankruptcy, and enforcement proceedings are generally stayed (frozen) as long as you remain current with your payments. This means that the tax foreclosure process should stop. However, during this time you also must remain current on all future taxes, or else the government can get the automatic bankruptcy stay lifted and continue with their foreclosure. You should therefore consult with an experienced bankruptcy lawyer as soon as possible to see whether chapter 13 will work for you. Of course, it requires that you have sufficient income to fund your payment plan. No attorney client relationship is created because I have responded to your question. However, you are welcome to contact my office in Racine, WI, to make necessary arrangements to retain me.
