Tenants Property Abandoned
I had tenants evicted from my property. Two days later I entered the premises and saw that they left an entire house full of stuff. Prior, they made statements to neighbors telling them that they were only taking a few things and were going to leave the rest for me to deal with. Apparantly they have now left the state. I sent a letter to their last known address saying I am charging them $35 per day storage and will dispose of items after 30 days as Section 704.05(5) states to do. Do their statements to the neighbors mean anything and give me cover if I dispose of their property before the 30 days or do I have to keep their stuff for the prescribed time period before I toss it? Obviously, I want to get rid of it as soon as possible as it makes re-renting or selling the property impossible.

I would recommend that a landlord always strictly comply with Chapter 704. Storage is one of the options, so you shouldn't be precluded from re-renting the premises.
