Legal Question in Real Estate Law in Wisconsin
Waiver of Lien
I am in the process of selling my home and as a contingency on the sale I agreed to fix some items that the FHA inpector found wrong. I have fixed most of them and have obtained a Waiver of Lein for those items. My realtor called yesterday and advised me that the people buying the house's realtor wants me to provide her with copies of the actual receipts. I don't feel that I should have to do that as I believed that's what the Waiver of Lien was for. I don't know why they need to know what I paid to have the repairs done. Do I need to provide the receipts with the price I paid?

Re: Waiver of Lien
I can't say for sure without seeing all the paperwork,
but my guess would be that the lien waiver would be
enough. Is is really worth a fight, however, to
preserve your secrecy on the price you paid the contractors?
I can understand their concern to a limited extent
due to the practice of some general contractors of
obtaining lien waivers in advance, signed in blank,
with the numbers filled in later. If such a blank
waiver is fraudulantly submitted, the contractor
could still potentially pursue his lien.
