misapplied tax payment

2002 I paid my property taxes with a check disbursed to

me by my mortgage lender. The City refunded me the

money and informed me I already paid. I spent 6

months trying to get specifics, because I knew this was

not true-I could get no information from the city. Now I

have a collection agency requesting repayment 1 year

later. The letter explained;

''In disbursing payment xxx or one of our lenders have

mistakenly paid your real estate taxes.''

If they voluntarily paid the city-Am I legaly responsible to

refund them? Do I risk legal acion being taken against

me if I don't?

Their mistake cannot result in a benefit to you. You owe the money and will ultimately have to pay it, even though you have kept the money thus far through no fault of your own.
