You do not say what you were charged with originally, but it sounds as if you are asking how to get a reduction to a lesser charge. Such reductions, when they occur, would normally be a part of a plea agreement which your attorney would negotiate with the District Attorney's office. You should therefore ask your lawyer to attempt to plea bargain for you. Whether the DA will do this or not depends upon too many factors to mention here, but the most common reason would be when the prosecution somehow doubts that they would be able to prove the original charge at trial. Your lawyer would therefore normally attempt to convince them that they have a proof problem of this nature. The best thing that you can do to help yourself is therefore to retain an experienced criminal lawyer. My comments here are not legal advice, nor do they create an attorney client relationship between us. However, you always more than welcome to contact my office in Racine to discuss any additional questions which you may have or to set up a free consultation.
