Legal Question in Traffic Law in Wisconsin

Our son was in the Lake Delton area this past summer visiting a friend and his parents and he received a $7.00 parking ticket on his vehicle. He and his friend approached a dnr officer as to how to pay the ticket before they leave the Delton area. The officer said, hmm we usually don't get to meet the people we give these to. Proceeded to leave leave and pulls up behind them again. Stated to them that you seem to be fine but did your friend have a couple of drinks. (passenger) Told him he had a couple with southern comfort and they agreed our son would not and be the driver. He asked where the bottle is, they stated they left it at his friends parents house where we were and the dnr officer said I could get you for littering??? What. Then, he told him to drive up this road in a parking lot, he proceeded to do so and entered a do not enter lane in a parking lot and the officer gave him a $170.00 ticket for not obeying a sign in a (parking lot). It was clear he wanted to get them on something and did. Even when our son and his friend initiated the contact. DA reduced the ticket to $162.00 and did not give him the time of day in a telephone conference. Want to take to court and fight.

Unfortunately for your son, there are no "free passes" for traffic violations just because he and his his friend initiates the law enforcement contact, so the "wrong way in a one way" violation could still stick if he was found guilty of it. However, if the officer admits to ordering him to pull into the "wrong way" driveway, he may have a defense. I would recommend that your son retain an experienced lawyer to represent him if he decides to contest the citation, however, since going to trial and losing can often be far worse than a carefully constructed plea agreement.
