Thank you for your answer, the facts are that I was a passenger in a friends car, a person pulled out in front of us and my friend had to hit the breaks. He hit them hard and only for a second which made upper body lurch forward and then back to the seat. I ended up with whiplash and 2 herniated discs. We didn't take down a plate # because we didn't hit anything.

You should consult with an experienced personal injury lawyer as soon as possible. Since you were a passenger, you would usually not be at fault, at least in terms of driving the car (absent unusual circumstances such as you grabbing the wheel or knowingly choosing to ride with an intoxicated driver). However, your driver (who apparently was insured) might be sufficiently at fault for you to recover, even if the adverse driver cannot be located. This assumes, however, that you can prove that your disk issues were caused solely by the accident. This could be tricky, since many people develop disk problems who have not ever been in any sort of accident. Medical causation is therefore nearly always disputed by the defense in such cases. Again, I would need a lot more facts to even begin to advise you.
