Legal Question in Traffic Law in Wisconsin
while having your temps is it legal to drive your drunk parents home?
1 Answer from Attorneys
While it certainly is not a good idea, assuming that your parents have sponsored your driver's license, my guess would be yes, it would be legal for them to still supervise your driving, even if they have been drinking. While driving practice requires an adult family member to be present and supervise, I do not know of any statutory requirement that the supervisor also be sober (although I have not researched this issue). The more interesting question, however, is whether or not they are somehow operating the vehicle since they are technically supervising you and could be arrested for drunken driving. Obviously having a drunken supervisor overseeing your practice driving is a very bad idea, even if it technically may not be illegal. My comments here are not legal advice, nor do they create an attorney client relationship between us. However, you always more than welcome to contact my office to discuss additional questions which you may have or to set up a free consultation at my office in Racine.
