Drivers License Confiscation After Traffic Stop, OWI, DUI in WI
In WI, officers usually confiscate the drivers license immediately following a drunk driving arrest. Your citation serves as a temporary driving receipt until the administrative (or refusal) suspension goes through on the DOT computer system. That often occurs 30 days after arrest if the driver does not file paperwork requesting a hearing on the refusal or administrative suspension within ten days. It
therefore critical that you immediately consult with an experienced criminal lawyer, since these rights expire very quickly. My comments here are not intended as legal advice unless I am subsequently retained on the case in question.
