Legal Question in Wills and Trusts in Wisconsin

Can Aunty Leave Everything to the Humane Society?

Recently, an aunt passed away and in her will designated her whole estate ($250,000)to the Humane Society. This may seem sweet for a lonely old spinster to do - but the truth of the matter is that the funds that built this estate are believed to in large been constituted from the sale of a family farm - my father-in-laws family farm (belonging to their Grandfather). My father-in-law and his sister are the only living relatives that Aunty had - she had a friend that helped her out a lot too (female).

My in-laws are far from wealthy - not that they expected much anything from the will, but to leave it all to the Humane Society - I just want to know if there is anything that can be done to contest the will - what should they do?

Re: Can Aunty Leave Everything to the Humane Society?

There are Wisconsin Statutes relating to the procedures

necessary to contest a will. There are legal requirements

for a will to meet to be valid. If any of those

requirements fail to exist, the will may be invalid, and

a will contest would be appropriate. Usually, the

most common grounds for contest are that the person

making the will was not competent, the person was unduly

influenced, or the will was inappropriately executed.

These are all fairly complex issues that an appropriate

attorney versed in these areas should be consulted. Good Luck!
