Legal Question in Wills and Trusts in Wisconsin

Dual contracts

If two parties commence a contract, and on a seperate day, commence a second contract (which is exclusive of the first), can both contracts be merged?

Contract A would be a benificiary agreement in a trust.

Contract B would be a lease agreement for property in the trust.

Re: Dual contracts

Hello,

You have posed an interesting question, the kind that law professors love to think about. However,

there is no doubt that this question cannot be answered without more facts, reading the contract itself, and learning the intent and purposes of the parties. Yes, there are times when agreements can be merged, replace an earlier agreement, etc. There are a host of possibilities. A key factor will likely be: what did the parties intend? I sugggest you contact a local lawyer and get an opinion you can rely on.
