In Wisconsin, transfers of a residence to a surviving spouse can generally be handled without a court proceeding, so long as the property was titled in the names of both spouses. If that is the case, you will need to have someone prepare or help you prepare a form HT-110. While this may handle the transfer, you really ought to talk with an experienced probate attorney to be sure you have not left any other ends unresolved. We have offices in New Berlin and Oconomowoc and lots of attorneys who could answer your questions. Good luck!
