Legal Question in Wills and Trusts in Wisconsin

I live in the state of Wisconsin, my husband passed away 5 years ago. He owned real estate property with his father and brother. I have been paying the expenses and taxes for my late husbands third of the property since he passed away. I am now being told that because my husband did not have a will when he passed away, that half of my third legally belongs to my husbands oldest son.

Can you tell me if this is true?? Does the property go to the oldest son, or my husbands oldest child? Or shouldn't the property be mine? My name was listed as his wife and co-owner.

Please help.

Michelle, you have some good questions, but any attorney who tries to answer you would have to ask for additional information to provide you a good answer. Most law firms will provide a "free first half hour."
