Legal Question in Wills and Trusts in Wisconsin

Managing Assets in May-December marriage

I am planning on marrying a man 15 years my senior who is ready to retire while I continue to work.

How do we manage our assets in case something catastrohic happens to my husband and he needs long term care?

Will my 401K and our home be attached if he would need to enter a nursing home?

Looking for recommendations on how we should plan for this.

Thanks for your guidance.

Since Wisconsin has Marital Property Law, you have a very complex situation. A Pre-nuptial agreement would help, but there are many other pieces that would still need attention. Since your situation is so complex, I'd suggest you contact an attorney well versed in Elder Law and Wisconsin Marital Property Law. Good Luck.

Hello, I agree with the other reply. I do seminars on such topics, but only cover the issues in general terms. There are so many variables that it is not possible to toss out a one size fits all solution for a couple. Yours is a case in point. Nonetheless, once all your facts are gathered, a strategy can be developed and implemented to meet most, if not all, your goals.

Best wishes,
