Legal Question in Wills and Trusts in Wisconsin
My mother is 80 and in a Nursing Home. She is currantly draining her life savings to pay for it and will have to go on Medicaid in about two years. she would like to give some of her money to her sons but is afraid she will be penalized by Medicaid when she needs to use it. Is there anyway she can give a portion of her estate to her children and still be able to use Medicaid when that time comes?

Your question deals with divesting of assets in an elderlaw situation. While we have several experienced elderlaw attorneys in our office, I am not one. You really need to meet with one to go over your options before you make application for any benefits. If you don't have an expert near you, you can contact the Wisconsin State Bar for a referral. Good Luck!
