My Mother past away without a will
My mother recently past away without a will and me and my older brother live in her home she owes less than a thousand dollars in medical expenses and the home is paid for we would like to know what do we should do to get the home in his name,we both would like to keep the home there's no,inhouse fighting at all we all agree on this what legal action do we take.

What you need to clear the title is a probate
proceeding. It could be done informally if
everyone is in agreement.

Assuming title to the home was in your mother's
name, you will need to have a probate proceeding to
transfer title to her appropriate heir. There are
many different types of proceedings, depending on
the total assets involved. This looks like it would
require an informal probate proceeding.
