Re: testamentary trust
A testamentary trust is sometimes referred to as a "will trust" because it is a trust which arises upon the death of the testator, under his or her will. So, by definition it requires the person who wants to use a testamentary trust to execute a will and to create the terms and conditions of the trust in the will.
