Trust pertaning to divorce

We are contemplating a divorce and would like to know if there is a way to set up a trust (similar to an A-B trust between married couples) whereby the surviving person would inherit the other person's property, with it ultimately going to the surviving children of our marriage. We would like to do something like this rather than go through a costly divorce to split up our property. At the present time we own property individually and are both close to 70 years of age. Thank you.

Thanks for your inquiry. Yes, it is possible to accomplish what you describe. Another tool that likely would be used is a marital property agreement. However, this planning is not a "do it yourself" situation. You could use some counsel specific to the needs and goals of your situation. If you would like to get a proposal from me, let me know. I am not sure where you are located, but it is possible that this could be arranged. Usually only two meetings are necessary, with the rest handled by mail or telephone.
