Will

My step Father recenlt passed away. He told me he had a will on several occasions. How do I go about locating it. His widow is not an option right now.

If your father's estate is large enough, not including property held as survivorshp marital property or joint tenancy (home or other real estate for example), passing by beneficiry designation (life insurance for example) or other non-probate transfers (lke a POD bank account), then in order for anyone to receive property under the terms of the will the will must be admitted to probate. Check with the register in probate in your county to see if the will has been filed.

If the amount is less than $50,000 the estate can be transferred by affidavit filed in the office of the register of deeds. Check there also.
