Yes, there is joint and several liability between the worker and the employer for work injury related medical bills. Employers sometimes dispute the bills and do not pay them unless ordered to do so by an administrative law judge from the worker's compensation division after a trial. It can take years to obtain such an order. Therefore, the employee often needs to deal with the bills via a bankruptcy, payment plan, etc. Bankruptcy works particularly well for such bills because the underlying claim for the amounts due to the worker are 100% exempt. This means that the injured worker gets to keep the entire claim proceeds without turning any of it over to the trustee, assuming that the exemptions are properly claimed. You should really consult with an experienced workers comp attorney, as well as a bankruptcy attorney about these issues. However, I may be able to represent you if you contact my Racine office and make arrangements see me.
