Legal Question in Disability Law in Wyoming

Falsified Application

I was fired on the bases that I falsified my application, the question was ''Do you need accommodations to perform any of the essential functions of the position in which you are applying for? yes no If yes, please list:'' I marked no, I did not realize that nitrile gloves and bleach water solution would be considered an accommodation, I also felt that the question was asking me to reveal my health status. Page 4 of the application is an Authorization form, It begins ''I certify to the best of my knowledge and understand that, if employed, falsified statements on this application shall be grounds for dismissal.''

Last paragraph reads ''This waiver does not permit the release of use of disability-related or medical information in a manner prohibited by the Americans with Disabilities Act (ADA) and other relevant federal and state laws.'' Upon going through the floor orientation 4 days into my training period, I noticed that only latex gloves and only antibacterial soap were visable. I asked about the availabilty to nitrile gloves and bleach water solution. I was fired the next day. I filed a charge through Labor Standards, they have stated that we resolve the matter between ourselves, what is my next step?

It is impossible to completely answer your question without knowing the company's position on this. If the company is willing to enter into some sort of settlement discussions, that is your next step. If the company is not willing to discuss settlement, then you have to weigh the merits of your case and the strength of your case moving forward into a lawsuit.
