Legal Question in Civil Rights Law in Wyoming
lie detector test
The police want my son to take a lie detector test to see if he is telling the truth. It is over a hat taken and found and returned to owner(ex-police chef). He is putting the presure on the police admenistration to press charges against my son (who has been in trouble only once). My son said he did not do it and my husband and I were with him all the time. I do not feel he has to take the test, what are his leagal rights? My son is 24 and is bordeline retardation (meaning he looks normal but only has a 3rd grade comperention).

Your son has no legal obligation to take a polygraph test. He has every legal right to refuse. He is protected under the 5th Amendment to the US Constitution. No competent criminal lawyer would allow this test under the circumstances you describe, particularly when administered by someone in law enforcement. Stand your ground.
