Legal Question in Credit and Debt Law in Wyoming
Do I owe?
My husband and I cleaned up his credit 2 years ago and paid all his past due bills from his credit report at the time. We recently received legal forms trying to sue us for a medical bill of $1000 from 2001. We had paid the original collections agency for another bill but weren't told about this one 2 years ago. We were told it had gotten lost somehow. After seeing some of your website, I am wondering if we are still liable where the collections agency hadn't done anything in 5 years.

Re: Do I owe?
First things first: If you or your husband have been sued, you need to respond to the complaint in the time indicated. Otherwise, the plaintiff can obtain a default judgment against you, which is a whole bigger headache to address.
To answer your question about whether the debt is still valid: It depends. You could argue that by failing to assert the debt two years ago, the collection agency has lost the right to assert it now. However, asserting this argument is legally complicated, so I would advise you to consult with an attorney ASAP. Also, whether this argument might work depends on a number of additional factors that I don't have information about.
