Legal Question in Criminal Law in Wyoming

False Information to Police

I am 19. I got arrested the other night for telling a

police officer I was born in 1979. He asked because we

had beer at the table. I then immediatly showed him my

drivers License stating I was only 19. I also recieved

an M.I.P. I have had one other M.I.P. before. What

kinds of penalties am I looking at? Could I

realisticly get jail time? Is there any way to get the

charge dropped or lessoned somewhat?

Thanks

Re: False Information to Police

Let me address your last question first. Whether

you can negotiate a reduction in charge is very, very

personal to the prosecutor, the officer, and the judge.

If any of these individuals is adamently opposed to

alcohol, it is unlikely you can negotiate a

lesser charge.

Sometimes, if you attend an alcohol counseling or

similar course, the judge will lighten the sentence.

For the MIP charge, you are looking at a maximum

sentence of 6 months in jail and $750.00 in fines,

plus court costs, including a mandatory $10 court

automation fee, and possibly victim's assistance

fund assessments. For the charge relating to your

response to the officer, I believe the penalties

are the same. You do not say whether you were charged

under a municipal ordinance or state statute, so I

assume statutory penalties apply. For your second

offense, returning to the comment I made at the

beginning, you may well face some jail time.
