Rebuttal to Aggreviated Assault/Return of Evidiance
My husband filed for divorce in july of 2000, i own a business he has returned broken into my home and tried to kill me my divorce attorney has tried to get the process going however it is 2/02 almost and I am still not divorced, he was sentenced and my question is if I was not aware of the attorneys agreement why I can't file a civil suit. Please advise all police and district attorney reports are available, note he was a union political figure as am I.

You can always file a civil suit. Whether a judge
will allow it to go forward or dismiss it depends
on many factors. The "attorneys' agreement" you
mention might be one factor which would cause a
judge to dismiss your suit.
