It is very critical that the definitions applied to Wyoming is clearly understood. The key here is whether or not either you were driving a motor vehicle or you were in control of the vehicle.

For example: the cop testifies that he followed your car without losing sight of the car and when you stopped there was no one else in the car, and you were the only person in the driver's seat with eth acr keys in your hand, the car did not otherwise stop, no one else either entered or existed the car then logically the cop can determine that you were the driver of the car. This is what is called circumstantial evidence. The other type is direct evidence where cop or other witness testifies that you were the driver.
