my question is i have a set of twins that are five, paternity was established in court and signed by their father at 15 months in which since then he has since gotten back with his x wife in order to avoid paying child support to her because when we were together she really socked it to him for the two kids, so i asked they give me 300 for my two kids instead of 630 like that was ordered because i worked and i couldnt see him not getting any paycheck, but then he was arrested for drugs i moved 100 miles away and he has made no attempt since 2003 to see or speak to the boys. i left a message for him and his wife called me back and said they wanted nothing to do with them, all i wanted was some family history because one of my boys was sick, and that was refused, now i have a fiance and a new baby and we purchased a house in both our names and i want to know if we need to be married for him to take over custody of the boys and what we need to do to start this process.

You should hire local counsel to get this straightened out, so you can move on.
You can also try to mediate it, and explain to his wife that he can release paternity and have nothing more to do with the boys if he signs on the dotted line, you might get a LOT of co-operation from her.
