Child Support

I am having a terrible time finding work to pay the child support that the court has ordered. I have one child my 8 year old daughter about 80% of the time and I have never met the other child that is 3 years old. The mother of the 3 year old has denied me any visitation when I was paying and I was not supposed to pay any child support on my 8 year old. I made a horrible mistake of not reading my divorce decree after 5 years of trying to settle on everything. Is there anything I can do besides a support modification? Any answers would be helpful I dont want to go to jail for this and leave my other child alone. Thank you a frustrated father.

I am not licensed in your state, so please do not consider this legal advice. Also, your question is not as clear as I would like if I were to address it in specific terms. Here, in a nutshell, is what I usually say about modifications in my state:

The absolute bottom line thing I would say to, no matter what your circumstances, is:

Any settlement you make with anybody, over any subject is not enforceable unless you do write

it down, both of you sign it, and file it with the proper court. Sure, you�ll save some bucks, but

it�s not going to mean anything if you and the other person get into an argument later on.

Get a modification of support through your state�s child support enforcement office. It�s

probably listed under your state Department of Health and Human Services. They can

recalculate child support based on your current circumstances but they cannot give you legal

advice. They can explain the child support statutes and the statutes� administrative rules, but they

can�t act as your legal counsel. Even so, I often tell lower income potential clients that they can

save a lot of money going through the slower process of using their state agency.
