division of personal property

my husband inhareted 25% of his mothers house which is worth about 100,000. am I entitaled to half of that. we are using no lawyer in this divorce... just a judge...thank you

You are not automatically entitled to receive half of your husband's inheritance, at least not by law, but perhaps in equity (fairness).

In other words, when you take all of yourproperty into account, would it be fair for a court to award you a portion of your husband's inheritance.

The court would also consider the length and the circumstances of your marriage. If you were married ten days, a judge would probably not give you any of the inheritance. If you were married 20 years and you helped his mother when she was sick or otherwise needed help, the division is more clear. If you refused to help his mother, but otherwise kept the family going while he helped his mother, the court might still award you some, but a smaller portion. If you refused to help in any way, or help was not needed, the judge might not award you anything.

And there are a million situations in between.
